THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN OBTAIN ACCESS TO IT. PLEASE REVIEW IT CAREFULLY.
Your rights
When it comes to your health information, you have certain rights. Global Therapy will help you exercise them as required by law.
Get an electronic or paper copy of your record. You may ask to see or receive an electronic or paper copy of your medical record and other health information we maintain about you. Psychotherapy notes, as specially defined by HIPAA and maintained separately from the medical record, may be subject to different access rules. We will ordinarily provide access or a summary within 30 days and may charge only a reasonable, cost-based fee permitted by law.
Ask us to correct your record. You may ask us to correct information you believe is incorrect or incomplete. We may deny the request in circumstances permitted by law, but we will explain a denial in writing, generally within 60 days.
Request confidential communications. You may ask us to contact you in a particular way or at a different address. We will agree to reasonable requests.
Ask us to limit what we use or share. You may ask us not to use or disclose certain information for treatment, payment, or health-care operations. We are generally not required to agree. If you pay in full out of pocket for a service, you may ask us not to disclose that service to your health plan for payment or operations; we will agree unless disclosure is required by law.
Receive an accounting of certain disclosures. You may ask for a list of certain disclosures made during the six years before your request. The list will not include every disclosure, such as most disclosures for treatment, payment, or operations. One accounting in a 12-month period is free; a reasonable cost-based fee may apply to additional requests.
Receive this notice. You may request a paper copy at any time, even if you agreed to receive it electronically.
Choose someone to act for you. A person with lawful authority, such as a guardian or health-care agent, may exercise rights for you. We will verify that authority before acting.
File a complaint. You may complain to Global Therapy's Privacy Officer or to the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
Your choices
In some circumstances, you may tell us whether and how to share information, including sharing with family, close friends, or others involved in your care or payment, or for disaster relief. If you cannot state a preference, we may share information when permitted by law and when we believe it is in your best interest or necessary to lessen a serious and imminent threat.
We will obtain written authorization for uses and disclosures that require it, including most uses and disclosures of psychotherapy notes, marketing that requires authorization, and sale of health information. We do not sell client information. If fundraising communications are ever used, you may opt out. Any fundraising involving records protected by 42 C.F.R. Part 2 will follow the additional requirements that apply.
How we typically use or share information
- Treatment. We may use your information and share it with professionals involved in your treatment or care coordination.
- Health-care operations. We may use and share information to operate the practice, supervise staff, improve care, conduct compliance and quality activities, and contact you when necessary.
- Payment. We may use and share information to bill health plans or other responsible parties and obtain payment for services.
Other uses and disclosures
We may use or share information in other ways permitted or required by law. These uses commonly require us to meet additional legal conditions. They may include:
- Public-health and safety activities, including certain disease reporting, product recalls, adverse-event reporting, legally required abuse or neglect reporting, and prevention or reduction of a serious and imminent threat.
- Health research when applicable legal requirements are satisfied.
- Compliance with federal or state law, including disclosures to HHS for HIPAA compliance review.
- Organ and tissue donation requests, when applicable.
- Work with a coroner, medical examiner, or funeral director after a death.
- Workers' compensation, lawful law-enforcement requests, health oversight, licensing-board activities, military or national-security functions, and other government requests allowed by law.
- Responses to lawsuits, administrative proceedings, court orders, subpoenas, warrants, or other legal process, subject to applicable privilege, notice, authorization, protective-order, and other legal requirements.
Mental-health and substance-use-disorder information
Federal and state law may provide greater protection to mental-health, substance-use-disorder, and other specially protected records. Global Therapy will apply the law that provides the required protection in the circumstances. To the extent we maintain substance-use-disorder patient records subject to 42 C.F.R. Part 2, those records will not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against the patient without the patient's written consent or a qualifying court order accompanied by a subpoena, as required by law.
Our responsibilities
- Maintain the privacy and security of protected health information.
- Notify affected individuals as required if a breach may have compromised privacy or security.
- Follow the duties and practices described in the notice currently in effect and provide a copy upon request.
- Use or share information only as described in this notice or otherwise permitted or required by law. If you give written authorization, you may revoke it in writing prospectively, subject to actions already taken in reliance on it.
Changes to this notice
We may change this notice, and the revised terms may apply to information we already maintain. The current notice will be available upon request, in the office, and prominently on our website. Material changes will be communicated as required by law.
